Introduction
In accordance with our commitment to uphold the privacy and rights of individuals depicted in any content available through our platform, we hereby outline the Appeal Procedure for Content Removal. This procedure is designed to address concerns related to the use of personal images and videos distributed on our website. We adhere to the principles set forth by the Digital Millennium Copyright Act (DMCA) and other applicable laws to ensure fair and lawful use of digital content.
Scope
This Appeal Procedure applies to any person (“Applicant”) depicted in content (images, videos, etc.) available for download or viewing on our website. It provides a structured process to challenge the use of such content based on the contention that consent was not given (e.g. a model release form was not signed), is void, or has been revoked in accordance with applicable laws.
Procedure
- Submission of Appeal:
- The Applicant must submit an appeal in writing to DWW Productions via email at the Contact Us page. The appeal should clearly identify the specific content in question and provide detailed reasons for the request for removal, including any evidence that consent was not given, is void under applicable laws, or has been revoked.
- Acknowledgment of Receipt:
- Upon receipt of the appeal, we will send an acknowledgment within five (5) business days, confirming that the appeal is under review.
- Investigation:
- An internal investigation will be conducted to review the appeal, which may involve reviewing any model release forms or other consent documentation provided at the time of content production.
- The investigation will be completed within thirty (20) days from the acknowledgment of receipt.
- Decision and Action:
- If the investigation determines that consent was not given, is void under applicable laws, or has been revoked, the content in question will be removed from this website promptly.
- The Applicant will be notified of the decision.
- Dispute Resolution:
- In the event of a disagreement over the outcome of the appeal, both parties must agree to submit the dispute to a neutral body for resolution. For the purposes of this procedure, the neutral body shall be an arbitrator or mediation service (“Giudice di Pace”) located in Busto Arsizio (Italy), unless otherwise agreed upon by both parties.
- The decision of the neutral body will be final and binding.
